agreement

These terms are an agreement between you and Machines at Play Inc. They apply when you access or use machinesatplay.com and related game-building, hosting, multiplayer, documentation, api, and command-line services. By using the service, you agree to these terms and our privacy policy.

eligibility and accounts

You must be at least 13 and old enough to consent under the law where you live. If you use the service for an organization, you confirm that you can bind that organization to these terms.

You may sign in through Google, GitHub, or Discord. Keep access to those accounts secure and give us accurate information. You are responsible for activity under your account and must tell us promptly about unauthorized use.

the service

The service may let you and your tools create world scripts and configuration, upload assets, host browser games, run multiplayer sessions, publish links, and claim or manage worlds. Features may be experimental, incomplete, or changed before general release.

your content

You keep ownership of content you submit. You give Machines at Play Inc. a worldwide, non-exclusive, royalty-free license to host, copy, process, modify for technical formatting, transmit, display, and distribute that content only as needed to operate, secure, improve, and provide the service. For content you publish publicly, this license includes making it available to other users and promoting the world or the service using reasonable excerpts or screenshots.

You confirm that you have the rights needed to submit the content and grant this license. You are responsible for your content, including content produced with an ai system or another third-party tool.

acceptable use

Do not use the service to:

• break the law or violate another person's rights;
• upload malware or attempt to bypass security, access controls, rate limits, or technical restrictions;
• interfere with the service or another user's use of it;
• harass, threaten, exploit, or deceive people;
• publish content that is unlawful, infringing, or sexually exploits minors;
• scrape, resell, or provide access to the service except through features we provide or written permission from us; or
• misrepresent a world's source, ownership, or affiliation.

We may remove content or restrict activity that violates these terms or creates risk for users, third parties, or the service.

software and service rights

Machines at Play Inc. and its licensors own the service, software, branding, documentation, and other materials we provide, except for your content and open-source components. Subject to these terms, we give you a limited, revocable, non-exclusive, non-transferable right to use the service for its intended purpose.

third-party services and ai tools

The service can work with third-party accounts, software, agents, models, libraries, and hosting systems. Their terms and policies apply separately. We do not control their output or availability. Review generated code and content before publishing it. You are responsible for deciding whether it is accurate, safe, and lawful.

fees

Some features may become paid. We will show the price and applicable payment terms before charging you. Taxes and third-party fees may apply. We will not charge a recurring fee without presenting the recurring terms first.

feedback

If you send ideas or feedback, you allow us to use them without restriction or payment. This does not transfer ownership of your other content.

suspension and termination

You may stop using the service at any time. We may suspend or end access, remove content, or limit features if you violate these terms, create legal or security risk, do not pay an amount due, or if we discontinue the service. Where practical, we will give notice and a chance to export content before a non-urgent termination.

disclaimers

To the fullest extent permitted by law, the service is provided "as is" and "as available." Machines at Play Inc. disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise that the service or user content will be uninterrupted, secure, accurate, or free of errors or harmful components.

limitation of liability

To the fullest extent permitted by law, Machines at Play Inc. and its officers, employees, contractors, affiliates, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from the service.

To the fullest extent permitted by law, our total liability for all claims arising from the service will not exceed the greater of the amount you paid us for the service during the 12 months before the event giving rise to the claim or 100 United States dollars. Some places do not allow certain exclusions or limits, so parts of this section may not apply to you.

indemnity

To the extent permitted by law, you will defend and indemnify Machines at Play Inc. and its officers, employees, contractors, and affiliates against third-party claims, damages, and reasonable costs arising from your content, your misuse of the service, or your violation of these terms or another person's rights.

disputes

Before filing a claim, you and Machines at Play Inc. agree to try in good faith to resolve it by written notice and 30 days of discussion. These terms are governed by applicable law, without regard to conflict-of-law rules. A dispute that cannot be resolved informally may be brought in a court that has jurisdiction over both parties, unless applicable law requires another forum.

changes

We may update these terms as the service changes. We will post the updated terms here and change the effective date. If a change materially reduces your rights, we will provide added notice when required. Continued use after updated terms take effect means you accept them.
